The Mumswhobake.co.uk website (referred to herein as the “Site”) is operated solely by and on behalf of Mums Who Bake Limited, a company registered in England and Wales with its registered office situated at Bushby Cottage, Talkin, CA8 1LE and registered under company number 06499168.
The purpose of the Site is to:
- provide retail customers with the ability to purchase products or services relating to home baking (either directly via the Site or by calling the Sales Helpline on 0772 943 0809); and
- provide those interested in home baking with access to a web-based forum through which ideas and experiences relevant to the field of home baking can be exchanged.
Use of the Site is subject to the Terms and Conditions set out herein and any applicable law, rules or regulations relevant to the Site and the products and services offered that may from time to time be in force.
Our contract with you
After you have placed your order we will send you an order acknowledgement by email. Our acceptance of your order and completion of our contract with you does not take place until the goods are dispatched to you. We will not be held wholly or partly responsible for any circumstances beyond our reasonable control, which cause the delay or failure to deliver the goods or services, or to comply with any other obligation.
We charge £3.95 the packing and delivery of goods. This charge remains the same whatever the size of your order. When goods are in our warehouse and are in stock we deliver within 3-5 working days of approving your order. For these purposes the term ‘working day’ shall mean any day in England that is not designated as a national public holiday. If delivery is likely to be longer, we will endeavor to give you a likely delivery date by contacting you via the contact details with which you have provided us when you first placed your order. If an item is unavailable, we may send an alternative, which you can return, free of charge, if it is unsuitable.
Your use of the products
All our products are for domestic use only. If you intend to use them for business, then you must check that they are suitable. You may also invalidate any warranty if the products are used for business purposes.
Using the product for domestic purposes: Subject always to an aggregate limit of £2.5 million we will be responsible for any loss that you suffer as a result of a product's failure, provided the reason for its failure was reasonably foreseeable by both you and us when the contract was completed.
Using the product for business purposes: We will not under any circumstances be responsible for any economic loss including, but not limited to, loss of profit, revenue, contracts, savings, loss of data, goodwill, reputation or other consequential loss. Our maximum liability will be limited to the replacement value of the product.
Whether products have been used for domestic or business purposes, Mums Who Bake Limited does not, by law, limit or exclude its liability for death or personal injury caused by negligence, breach of duty, gross negligence or willful misconduct. This clause does not affect your statutory rights as a consumer.
Returning goods to us
You have 14 days from the receipt of your order in which to return any item to us. They must be in their original condition. Once we have received your returned goods, we will refund your money in full, using the same method by which you paid for them. Please notify us, in writing, within 48 hours, of receipt of the goods, of your intention to return them. Postage is not refunded unless the product was faulty.
Order Codes
Order Codes tell us which promotion or special offer you are entitled to claim with your order. The order code is for you personally, and remains the property of the Mums who Bake Limited at all times. Unless stated otherwise, order codes can only be used once and may not be redeemable against all items. If you place more than one order using the same order code, your first order only will be accepted. We reserve the right to restrict or refuse orders and substitute gifts where necessary.
Limitations
You may not use the Site for any of the following purposes:
- disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
- transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
- gaining unauthorised access to other computer systems
- interfering with any other person's use or enjoyment of the Site
- breaching any laws concerning the use of public telecommunications networks
- interfering or disrupting networks or web sites connected to the Site
- making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
- Mums Who Bake Limited reserves the right to refuse to post material on the Site or to remove material already posted on the Site.
- You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
- any claim by any third party that the use of the Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
- any claim by any third party that the use of the Site by you infringes that third party's copyright or other intellectual property rights of whatever nature; and
- any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Site by you.
Availability of the Site
Although Mums Who Bake Limited aims to offer you the best service possible, it makes no promise that the services that it offers via the Site will meet your requirements. Mums Who Bake Limited cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to the Customer Services 0772 943 0809 or by email at: info@mumswhobake.co.uk and we will attempt to correct the fault as soon as we reasonably can.
Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Mums Who Bake Limited will attempt to restore the service as soon as it reasonably can.
Mums Who Bake Limited’s right to suspend or cancel your registration
Mums Who Bake Limited may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the Site.
The suspension or cancellation of your registration and your right to use the Site shall not affect either party's rights or liabilities.
All paragraphs in these Terms and Conditions shall survive cancellation.
Mums Who Bake Limited’s liability
The Site is provided by Mums Who Bake Limited without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
The Site provides content from other Internet sites or resources and while Mums Who Bake Limited tries to ensure that material included on the Site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Mums Who Bake Limited will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Site. If Mums Who Bake Limited is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.
In particular, we disclaim all liabilities in connection with the following:
- incompatibility of the Site with any of your equipment, software or telecommunications links
- technical problems including errors or interruptions of the Site
- unsuitability, unreliability or inaccuracy of the Site
- inadequacy of the site to meet your requirements
To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Site.
Nothing in this paragraph applies to Mums Who Bake Limited’s liability in respect of products sold through the Site.
Nothing in these Terms and Conditions shall exclude Mums Who Bakes liability for personal injury or death caused by its negligence.
Third Party Websites
As a convenience to Mums Who Bake Limited customers, the Site may from time to time include links to other web sites or material which are beyond its control. Mums Who Bake Limited shall not be liable for any material posted to such web sites nor any reliance placed upon any information posted on such websites or action take as a consequence thereof.
Advertising and Sponsorship
Part of the Site may contain advertising and sponsorship. Advertisers and Sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.
Miscellaneous
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
If you breach these Terms and Conditions and mwb.co.uk ignores this, mwb.co.uk will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. Mums Who Bake Limited shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
Trading Area and VAT
Our merchandise (except certain stated items) is for sale within the UK, Channel Islands, the Isle of Man and Northern Ireland only. All prices include VAT unless the product is exempt. No discount will be given on products where VAT is not chargeable, nor accountable to HM Customs & Excise or similar authority within the European Union. Where VAT is chargeable, we reserve the right to amend our prices to reflect any changes in VAT that may occur. The new price will be shown on the product page on the site, your order confirmation email and delivery note.
Data Protection Act 1998
As a matter of policy Mums Who Bake Limited will comply with the provisions of the Data Protection Act 1998. Mums Who Bake Limited is registered to hold personal data under the Data Protection Act 1998 and, in accordance with this registration, may from time to time process personal information (such term being construed in accordance with the Data Protection Act 1998) in furtherance of its legitimate business objectives. Such personal data may include maintaining a database of customer names and addresses, records of past order details and other information (including information obtained from cookies (see section 10. below) that has been lawfully obtained by it for the purposes of identifying products and services what may in the future be of interest to customers. Mums Who Bake Limited will not pass information obtained from its customers on to other organizations except where this is required by law or to support the detection or prevention of a criminal activity.

To provide you with specially tailored information from our website and to track the effectiveness of online advertising we, in conjunction with third party companies, may use cookies.
Cookies are pieces of data that a website can send to your browser and may then be stored on your system. They show which pages on a site you have seen and any advertisements that may be placed on them. They also help us identify which are the most popular areas of our site and those which need to be improved to make them easer to use. Most web browsers automatically accept cookies. Consumer Protection ( Distance Selling ) Regulations 2000
All home shopping companies must give 7 days in which customers can cancel or return any item in their order. To make shopping easier for you, Mums Who Bake Limited has extended this period to 14 days.
Copyright and Trademark
The use of Trademarks advertising our merchandise should not be taken as indicating the merchandise's country of origin.
Alteration to the Terms and Conditions, Waiver & Governing Law
We reserve the right to amend these terms and conditions if necessary. You will be subject to the terms and conditions at the time that you use the website unless and to the extent that any change is required by law or government authority. If any of these terms and conditions is deemed invalid or unenforceable by any competent authority, that condition will be removed. This will not affect any of the remaining terms and conditions. Any delay or failure by us to exercise our legal rights within our contract with you should not be seen as a waiver of our legal rights. These terms and conditions and the contract between you and us will be governed by the laws of England and any disputes will be resolved exclusively in the English courts.
The Cake Workshop - Cake Decorating Classes
All our classes are run by The Cake Workshop in association with Mums Who Bake ltd.
Please take great care checking the course date when booking your place on one of our classes because we cannot offer refunds.
In the unlikely event that we have to cancel a class a full refund or a replacement class date will be offered.
Should you need to cancel your place on a course please give as much notice as you can. If we are able to fill your place on the class we may be able to offer you an alternative course date. This, however, is totally at the discretion of Mums Who Bake and cannot be guaranteed.
Please note that your place on our course isn’t secured until full payment has been made and you have received your confirmation email.
Our classes take place at our office at Warwick Mill Business Village, nr Carlisle, Cumbria unless otherwise stated. Please check the venue before making your booking.
Our classes require a minimum of 3 attendees to run. In the unlikely event that this number is not achieved we will contact you immediately and offer you a replacement course or refund.
If you are booking a place on a course for someone else please forward us the contact details of the course attendee. Without this information all class details will be sent to you rather than the attendee.
Except for our specific children’s classes under 16’s are not allowed to attend our classes unsupervised. Under 16’s can attend the classes, however, if they are accompanied by a full fee paying adult.
Please note that the classes are not designed with children in mind so if you are unsure whether the class will be suitable for your child please contact us before making your booking.
